everhard.games (together with related properties, games, apps, and platforms, the “Websites”) is owned and operated by Everhard Games INC, a corporation organized under the laws of the State of Delaware, USA (“Everhard”, “we”, “us”, or “our”). We provide online games and related services (“Game(s)”) via the Websites and their associated properties (collectively, the “Services”).


Payment processing for purchases on the Websites (including any virtual currency) is carried out by our third‑party payment processors.


Please read this Privacy Notice carefully. By accessing or using the Websites, you acknowledge that you have read and agree to the practices described here. If you do not agree with any part of this Privacy Notice or our Terms, please do not use the Websites or submit personal data to us.

1. Scope


For this Privacy Notice, “process,” “processed,” or “processing” means any operation performed on personal data (excluding disclosure), whether automated or not, including collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, alignment, combination, restriction, erasure, or destruction. Information about disclosure appears in Section 6 (Disclosure of Your Personal Information).


This Privacy Notice applies to information we collect:


  • on the Websites;

  • in email, text, and other communications between you and the Websites;

  • through mobile applications we provide that interact with the Websites; and

  • when you engage with our ads or apps on third‑party sites and services that link to this Privacy Notice.


This Privacy Notice does not apply to information collected by:


  • us on other sites we operate that have their own privacy notices; or

  • any third party (including affiliates), including through applications or content (such as ads) that may link to or be accessible from the Websites. We do not control and are not responsible for the privacy statements of those third parties.


2. The Data We Process About You


Personal Information” means any information that identifies, relates to, describes, or could reasonably be linked with a particular individual. It does not include data that has been de‑identified, anonymized, or pseudonymized.


We may process different categories of Personal Information depending on whether you register an account.


Visitors without an account (“Unregistered Users”)


  • Website activity data: information about how you browse and use the Websites and Services, the content and ads you interact with, pages viewed, on‑site searches, the referring URL, device and OS details, browser settings (including time zone), and online identifiers (e.g., IP address). We also use cookies and similar technologies (see Section 7).

  • Age‑verification identifiers: in some jurisdictions, users may be asked to provide identifiers (e.g., government‑issued ID) to prove they are of legal age to access adult content. Such verification is handled by trusted third‑party age‑verification providers. Data submitted for verification is processed by those providers and is not transmitted to Everhard. Their privacy policies govern that processing.

  • Online forms & communications: information you submit via forms, email, or support chats (e.g., contact details, support requests, reports, moderation or complaint submissions).


Users with an account (“Registered Users”)


In addition to the above, we also process:


  • Contact Data: name, billing address, email address, telephone number.

  • Profile Data: username, password, country, gender, purchase history, interests and preferences, feedback, and survey responses.

  • Transaction Data: payment method details (e.g., card last four digits or token), records of payments to and from you, and details of products/services you purchased or received.

  • Technical Data: IP address, login timestamps, browser type/version, time zone and approximate location, plug‑in types/versions, OS and platform, and device identifiers.

  • Marketing & Communications Data: your preferences for receiving marketing from us and third parties, and communication preferences.


We may also create and use aggregated insights that do not identify you directly or indirectly. Aggregated information is not Personal Information.


3. Sources of Personal Information


We collect Personal Information:


  • Directly from you: when you register, complete forms, search on the Websites, subscribe to Services, use in‑site chat, take surveys, enter promotions, report issues, or request support.

  • Automatically: via cookies and similar technologies as you navigate the Websites (see Section 7).

  • From third parties: including members of our corporate group, business partners, verification and fraud‑prevention providers, analytics vendors, and other service providers.


4. How We Use Personal Information


We use Personal Information to:


  • Provide the Services: operate and display the Websites and content; deliver the features you request; administer contests and sweepstakes (including eligibility checks and prize delivery).

  • Manage accounts (Registered Users): maintain your account; provide customer support via chat or email; send transactional notices about your account, purchases, or changes to the Websites or Services.

  • Personalize content and ads: research and analyze your use of the Websites to tailor on‑site content and advertising to your interests, including on third‑party sites subject to your choices (see Section 9).

  • Marketing communications: contact you about products or services that may interest you from us or selected partners (subject to your preferences).

  • Analytics & measurement: understand usage patterns; distinguish unique from repeat users; track aggregate metrics (e.g., total visitors, pages viewed, general demographics).

  • Functionality & security: monitor, detect, investigate, and prevent fraud, abuse, cheating, and other unlawful activity; diagnose and fix technical issues; protect our users and our platform.

  • Platform safety: foster a safe environment, including content moderation and enforcement of policies.

  • Compliance: enforce our Terms and comply with legal obligations.

  • Other purposes with consent: any additional use you are informed of at the time of collection and, where required, consent to separately.


5. Legal Bases (EU/UK/Canada)


Where required by law (e.g., in the EEA/UK/Canada), we process Personal Information only when one or more lawful bases apply:


  • Consent: e.g., personalized ads or email marketing; biometric/age verification handled by third‑party providers (you may withdraw consent at any time).

  • Contract: to create and manage your account, provide the Services, and process transactions you initiate.

  • Legal obligation: to satisfy statutory, regulatory, tax, accounting, or law‑enforcement requirements.

  • Legitimate interests: to secure our Services, prevent fraud and illegal activity, improve and analyze the Websites, and market to adult users—balanced against your rights and interests.

  • Vital interests: to protect you or others (e.g., in emergencies).

  • Public interest: where allowed by law to combat unlawful behavior.


Depending on the processing, different bases may apply to the same data. If you reside outside the EEA/Switzerland/UK, bases may differ under your local laws.


6. Disclosure of Your Personal Information


We share Personal Information only as described below:


  • Within our corporate group: with entities that control, are controlled by, or under common control with Everhard, for the purposes described in this Notice.

  • Service providers (processors): with authorized providers performing services for us (e.g., payment processing, fraud detection, customer support, analytics, hosting, security, age verification, marketing tools, surveys, and contest administration). They may access Personal Information solely to perform services for us and must not use it for other purposes. Where required, we have data‑processing agreements in place.

  • Business transfers: in connection with a merger, acquisition, restructuring, or sale of assets where user data is transferred. We will endeavor to ensure the recipient uses your data consistently with this Notice.

  • Legal and safety: where we reasonably believe disclosure is necessary to comply with applicable law, legal process, or governmental request; to enforce our terms; to investigate or prevent illegal activity or security issues; to protect the rights, property, or safety of Everhard, our users, employees, or others; or to maintain the security and integrity of our infrastructure. We may raise or waive legal objections in our discretion.


We may also share aggregated or de‑identified information that does not identify individuals.

7. Information Collected Automatically (Cookies, Beacons & Analytics)


As you use the Websites, we automatically collect device and usage information, including IP address, browser type, OS, referring URL, pages viewed, approximate location, mobile carrier, device/application IDs, on‑site searches, and cookie data.


Technologies we use include:


  • Cookies: small text files stored in your browser/device.


    • Strictly necessary cookies (essential for core functionality like login and access controls).

    • Analytical/performance cookies (help us understand how users navigate and improve the Websites).

    • Functionality cookies (remember choices like language).

    • Targeting/advertising cookies (record visits, pages viewed, and links followed to make content and ads more relevant).



You can manage non‑essential cookies via the “Manage cookies” link in the Websites’ footer. Disabling certain cookies may impair some features.


Cookies may be session (deleted when you close the browser) or persistent (remain until they expire or you delete them). We do not currently respond to Do Not Track signals.


  • Flash cookies (LSOs): may be used for features such as media playback and are managed separately from browser cookies (see Section 9 for control options).

  • Web beacons / pixels: tiny files embedded on pages or emails to help deliver cookies, count visits, understand usage, and verify system integrity.

  • Analytics & ads: We use third‑party tools, including Google Analytics and Google Ads/DoubleClick (Google LLC, USA). These services collect information such as IP addresses, device and software identifiers, referring/exit URLs, on‑site behavior, features used, purchase history, MAC address, and mobile device IDs via cookies or similar tech.


    • We enable IP anonymization in Google Analytics/DoubleClick so that, within the EU/UK where applicable, Google truncates IP addresses before storage. In rare cases, the full IP may be sent to US servers and shortened there.

    • Google uses the information to evaluate use of the Websites, compile reports, and manage ad content. Data may be stored on servers in the United States under appropriate transfer mechanisms (e.g., EU Standard Contractual Clauses and/or the EU‑US Data Privacy Framework and applicable extensions).

    • You can learn how Google uses data and opt out via Google’s tools or by accepting only necessary cookies (see Section 9).



8. Third‑Party Cookies and Tracking


Some content, applications, and advertisements on the Websites are served by third parties (ad networks, analytics providers, content platforms). These third parties may set cookies and/or use web beacons and similar technologies to collect information about you over time and across different websites and services for interest‑based advertising or analytics. Unless stated otherwise, we do not provide your Personal Information to these third parties; however, they may associate the data they collect with Personal Information they already hold about you.


We do not control third‑party tracking technologies. For opt‑out options, see Section 9.


9. Your Choices


We strive to provide meaningful choices about Personal Information:


  • Providing data: You may choose not to provide certain information. Some features (e.g., registration, purchases, contests) require specific data and may be unavailable without it.

  • Cookie controls: Use the “Manage cookies” footer link or your browser settings to block/limit cookies. Note that blocking may disable some features. Manage Flash cookies via Adobe’s Settings Manager.

  • Analytics & ads:


    • Opt out of Google Analytics: install the browser add‑on or limit cookies via our consent tools.

    • Google Ads personalization: adjust settings at adssettings.google.com.

    • Mobile interest‑based ads: enable Limit Ad Tracking (iOS) or Opt out of Ads Personalization (Android).

    • Industry tools: Digital Advertising Alliance (optout.aboutads.info), Network Advertising Initiative (optout.networkadvertising.org), or EDAA (youronlinechoices.com) in Europe.


  • Marketing emails: Use the unsubscribe link in our emails or update preferences in your account. We may still send essential transactional messages (e.g., purchase confirmations, security alerts).

  • Account deletion: You may deactivate or delete your account unless we are legally required to retain it. Deletion removes profile access and is typically irreversible. If you return later, you’ll need to create a new account.


10. California Consumer Privacy Act (CCPA) Notice


If you are a California resident, you may have the following rights (subject to exceptions): to know/access, delete, correct inaccurate Personal Information, limit certain uses, opt out of sale (if applicable), and to be free from discrimination for exercising your rights.


We do not sell Personal Information for money and have not done so in the preceding 12 months. We may share data with service providers or affiliates for operational purposes as described in Section 6.


To exercise your CCPA rights, use the self‑service options in Section 23 or email support@everhard.games with subject “CCPA Request.” To verify your identity, we may require your username, the email linked to your account, and additional details. You may designate an authorized agent by supplying a notarized power of attorney or written authorization and completing our verification steps.


11. Biometrics


Where required (e.g., for age or identity verification), we may engage third‑party providers that use facial recognition to compare a live image/selfie with your government‑issued ID and generate a mathematical representation of facial features (which may be considered biometric information in certain jurisdictions). Our providers share verification results with us (e.g., pass/fail, confidence score). We only use biometric verification to confirm you are a real person and to help verify age where legally required. Processing occurs subject to your consent, and third‑party provider privacy terms apply. Biometric data is retained only as long as necessary by the provider and is not stored by Everhard beyond the verification outcome.


12. Financial Information


Financial details you provide are used solely to initiate and complete transactions and are shared only with our payment processors and relevant financial institutions. Transactions are processed using industry‑standard encryption. We do not disclose your financial data to third parties except with your authorization, to complete your transactions, or as required by law. Third‑party payment services are governed by their own terms and privacy notices.


13. International Data Transfers


We and our service providers may process your Personal Information in countries other than your own. When transferring Personal Information from regions with comprehensive data protection laws (e.g., EEA/UK/Switzerland), we use appropriate safeguards, such as Standard Contractual Clauses, relevant adequacy decisions (including the EU‑US Data Privacy Framework and applicable extensions), or other lawful transfer mechanisms. By using the Websites, you consent to these transfers as described in this Notice.


14. Data Retention


We retain Personal Information only as long as necessary to fulfill the purposes described here, including legal, accounting, or reporting requirements. We consider the amount, nature, and sensitivity of the data, risk of harm from unauthorized use/disclosure, the purposes for processing and whether they can be achieved by other means, and legal requirements. When no longer needed, we delete or de‑identify the data. Upon request and where permitted, we will delete your Personal Information (see Section 16).


15. Security


We implement technical, organizational, and physical safeguards to protect Personal Information, including encryption in transit, firewalls, access controls, monitoring, and staff training. While we strive to protect your data, no system can be guaranteed 100% secure. You are responsible for maintaining the confidentiality of your password and account credentials.


16. Your Rights


Subject to local law, you may have rights to:


  • access the Personal Information we hold about you and information about its use;

  • rectify inaccurate or incomplete Personal Information;

  • erase Personal Information (“right to be forgotten”);

  • data portability (receive your Personal Information in a structured, machine‑readable format and transmit it to another controller where technically feasible);

  • object to processing based on our legitimate interests or public interest;

  • restrict processing in certain circumstances; and

  • withdraw consent where processing is based on consent.


If you are in the EEA/UK, you may also lodge a complaint with your local data protection authority. You can exercise access/deletion via the tools in Section 23 or by emailing support@everhard.games. We may need to verify your identity to process requests. Note: some deletion requests may require deleting your account, as core account functionality depends on certain Personal Information (e.g., your email).


17. Changes to This Privacy Notice


We may update this Privacy Notice from time to time. When we make material changes, we will provide reasonable notice (e.g., on‑site banner, account notice, or email). The most current version will be available at https://everhard.games/legal/privacy (or a successor page). Your continued use of the Websites after changes take effect constitutes acceptance of the updated Notice.


18. Enforcement & Cooperation


We periodically review our compliance with this Privacy Notice. If you have questions or concerns about our handling of Personal Information, contact us at support@everhard.games. We will investigate and respond. We cooperate with relevant regulators, including data protection authorities, to resolve complaints we cannot resolve directly.


19. Notice to Law Enforcement


We respond to valid legal process consistent with U.S. law. Law enforcement requests should:


  • be issued by a court or competent authority with proper jurisdiction;

  • clearly identify the information sought and the legal basis; and

  • be sent to legal@everhard.games.


We reserve the right to require formal service of process and to object to requests that are overly broad, lack proper authority, or otherwise do not comply with applicable law. Where permitted, we may notify users of requests for their information.


20. No Third‑Party Rights


This Privacy Notice does not create any rights enforceable by third parties, nor does it require disclosure of any Personal Information to third parties except as described herein or required by law.


21. Our Policy Toward Minors


The Websites include age‑restricted content, including nudity and explicit sexual imagery, and are intended only for adults (18+) or the applicable age of majority where you access the Websites. We do not knowingly collect Personal Information from minors. If you believe a minor has provided Personal Information to us, please contact support@everhard.games so we can remove the information and terminate the account.
